Terms of Service

These Terms are a binding agreement between you and ALTIOR Virtual Marketing, LLC ("ALTIOR," "we," "us," or "our") governing Elite Prompt Builder on the web and in our mobile application (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old and legally able to enter this agreement. If you use the Service for an organization, you represent that you may bind that organization.

Elite Prompt Builder is a software service that guides users through creating structured prompts for text, image, and video AI tools. Features may include reusable templates, prompt frameworks, saved prompts, brand profiles, uploaded reference documents, knowledge-base tools, and AI-assisted prompt generation.

The Service prepares prompts and related materials. It is not a substitute for professional legal, medical, financial, or other regulated advice, and it does not guarantee the accuracy, availability, legality, or suitability of outputs produced by Elite Prompt Builder or third-party AI systems.

You agree to provide accurate information, protect access to your account, and notify us promptly of suspected unauthorized use. You are responsible for activity performed through your account. Google sign-in is optional and is governed by Google's terms in addition to these Terms.

The Service may offer free features, recurring subscription plans, and one-time digital purchases. Prices, taxes, included features, usage limits, and billing intervals are displayed before purchase.

Web purchases are processed by Stripe. Purchases offered within a mobile app marketplace are processed by that marketplace and are subject to its billing terms. Recurring plans renew automatically until canceled. You authorize the applicable billing provider to charge each renewal at the then-current disclosed price.

Cancel through the same provider used to purchase. Cancellation stops future renewals and generally takes effect at the end of the paid period. Deleting an account does not automatically cancel a third-party subscription.

Except where required by law or the applicable marketplace's rules, payments are non-refundable and we do not provide prorated credits for unused time. Any marketplace purchase refund must be requested through that marketplace.

You retain ownership of prompts, brand materials, documents, and other content you submit ("User Content"). You grant us a limited, non-exclusive license to host, process, reproduce, and transmit User Content only as needed to operate, secure, support, and provide the Service and to fulfill features you request.

You represent that you have the necessary rights to submit User Content and that it does not violate law or another person's rights. Do not upload confidential, regulated, or sensitive personal information unless you are authorized to do so and accept the associated risk.

You may not use the Service to violate law; infringe intellectual-property, privacy, or other rights; distribute malware; bypass access or usage limits; interfere with security; reverse engineer protected portions of the Service except where law permits; impersonate others; facilitate fraud; or create, request, or distribute harmful, abusive, or illegal content.

We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect users, third parties, or the Service.

The Service, software, design, branding, and original materials are owned by ALTIOR or its licensors. We grant you a limited, revocable, non-transferable right to use the Service under these Terms. Preset templates are licensed for your permitted use; they are not sold to you unless expressly stated otherwise.

The Service relies on third parties such as Base44, Google, Cloudflare, Stripe, mobile marketplaces, and AI service providers. Their services and terms may apply separately. We are not responsible for third-party services or for changes, interruptions, or outputs outside our reasonable control.

Our Privacy Policy explains how we handle information. You may request account deletion from Settings in the Service or through our public account deletion page. We may verify identity before deletion and retain limited information where legally required.

We may add, change, suspend, or discontinue features and may update limits or pricing prospectively. We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. We may provide notice when a material change affects a paid plan.

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that outputs will be accurate, original, safe, or suitable for a particular use. You are responsible for reviewing prompts and AI-generated results before using or publishing them.

To the maximum extent permitted by law, ALTIOR and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or harm arising from third-party AI outputs. Our aggregate liability relating to the Service will not exceed the greater of $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim.

You may stop using the Service at any time. We may suspend or terminate access for a material breach, unlawful conduct, security risk, nonpayment, or discontinuation of the Service. Provisions that by their nature should survive termination will survive.

We may update these Terms as the Service or legal requirements change. We will post the updated date and provide additional notice when a change is material. Continued use after the effective date means you accept the revised Terms.
